INTRODUCTION

 

This website is operated by Wild at Heart - Charlie Armour. Where these terms and conditions use terms such as "we", "us" and "our" they refer to Wild at Heart - Charlie Armour. 

By visiting our website, including all the information, tools and services available on it, and/or purchasing something from us, you are deemed to have accepted these terms and conditions, and the associated privacy policy available here.

You can view the most current version of these terms and conditions at any time by visiting this website page. We reserve the right to update, change or replace any part of these terms and conditions, without prior notice to you, by posting updates on this page. It is your responsibility to check this page on each visit to your website, read these terms and conditions and ensure you understand them before making a purchase.

 

 

CHANGES TO SERVICES AND PRICES

 

At any time, we reserve the right to change or discontinue any items listed on this website without warning.

 

Items listed for sale with an image do not necessarily guarantee the exact flowers and colours displayed but we will endeavour to match them as closely as possible. We reserve the right to include different flowers and foliage to those shown on the website.

 

We accept no liability to you or to any third-party for any changes, discontinuations or suspensions of any of our services.

 

We reserve the right to amend the prices indicated on our website at any time, without notice.

 

 

ORDERS AND CANCELLATIONS

When you place an order, you will receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us unless collection or delivery has been arranged also.

Orders for fresh flowers may be amended or cancelled up to 48 hours before the intended delivery date. Any cancellations after this time will not receive a refund. Items cancelled with more than 48 hours prior to delivery will receive a refund. Any cancellations need to be requested by phone or email.

 

Orders for non-fresh items may be amended or cancelled up to the point of postage. We aim to dispatch items within 1-3 working days. We are unable to cancel orders once they have been dispatched. If your order has already been dispatched by the time you contact us, please return your package unopened and undamaged and we will refund you on receipt of the returned package, minus any postage costs.

 

In extreme circumstances beyond our control such as bad weather and crop failure, there may be a time where we cannot fulfil your order. You will be notified within 24 hours of delivery and offered a full refund.

 

To amend or cancel your order, please contact us using our contact details.

 

All orders received are subject to acceptance by us and we reserve the right, at our absolute discretion, to reject any order without giving reasons. In the event of rejection, we will refund or cancel any payments received in full, via the payment method used to place the order.

 

Please ensure you check your emails and respond to any email from us if necessary (this should not be here but instead used when ordering).

 

 

 

PAYMENTS

 

We never store or have access to your credit or debit card details.

 

DELIVERY

 

We currently deliver within the United Kingdom only.

 

By committing to a purchase on this website, you are ensuring that you or the intended recipient live within the appropriate delivery zones you apply for.

 

When placing your order you are able to specify further delivery information using the 'Add a Note' field provided in the cart page or contact me directly. This is intended to provide further guidance to the party delivering your order which isn't included within your address information, for example to specify floor number, or hospital ward. We reserve the right to not action any delivery requests specified in this field which we deem unacceptable and will endeavour to use other elements of address information provided elsewhere on the order form to fulfil your order.

 

We aim to dispatch orders, other than fresh flowers, within 3 working days of receipt of the paid order.

 

Dried goods orders are sent via Royal Mail or Parcelforce. We therefore cannot guarantee that delivery instructions will be followed. Orders left in a safe place are done so at your own risk.

 

We cannot be held responsible if a delivery arrives late due to the postal service or any other reason outside our control.

 

When you purchase a fresh flower item on this website you understand that the order cannot be fulfilled that same day and delivery will not take place until a suitable date has been arranged via email.

Orders of fresh flowers must be finalised by email a minimum of 48 hours before collection or delivery.  An order is not considered placed until a confirmation is sent detailing expected availability and collection time, and payment has been made.

Collection of fresh flowers is from Wrington at times by mutual agreement. Delivery is possible if fairly local or by mutual agreement and will incur a charge if not in the immediate catchment area as deemed by us.

Local collection or delivery times and dates need to be mutually convenient. There is no guarantee that your delivery can take place exactly when you want it, especially during busy periods or when we have other commitments. We will endeavour to be as accommodating as possible.

 

If the recipient of fresh flowers is unlikely to be in on the day of delivery you will ensure that an appropriately sized, clean vessel of water is left in a shady place at the property for the flowers to be put in and notify us of its whereabouts. If this is not available then we reserve the right to not deliver the flowers and a charge will be incurred.

 

 

  

RETURNS AND REFUNDS

 

Whilst we agree to use all reasonable endeavours to ensure that delivery will be on the requested delivery date you acknowledge that in very occasional circumstances delivery on the requested terms will not be possible. In such circumstances you will be given prior notice wherever possible and we shall either make alternative arrangements or shall reimburse your payment in full.

 

If, for whatever reason, your flowers have not arrived within 14 working days of your placing an order, please contact us and we will send you a free replacement on our next available delivery date or a refund.

 

Any cost of returning unwanted items is to be paid by the customer, except if the item is faulty. We recommend to all customers returning items to use a signed or tracked service, as we will be unable to refund any items that are not received.

 

We carefully pack our dried flowers to ensure they arrive in perfect condition. However, occasionally, they may get damaged in transit. Should this occur, please email us a photo of the damaged flowers within 24 hours of receipt. If, at our sole discretion, the flowers appear damaged, we will offer you a free replacement at our next available delivery date or a refund.

 

Due to the perishable nature of fresh flowers we are unable to accept returns of these. In order to assist us in resolving any issues quickly, should you have any concerns about any of the fresh flowers, please contact us within 24 hours of the date of delivery.

 

If we offer you a refund, we will refund you the full amount within 3 days. Please note that banks may take an additional 3-5 days to refund the amount to your card.

 

 

 OFFERS AND PROMOTION CODES

 

Discounts and voucher codes cannot be redeemed against delivery charges.

 

 

 

INTELLECTUAL PROPERTY RIGHT AND USE

 

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the website shall remain at all times vested in us. You are permitted to use this material only as expressly authorised by us.

 

 

LIABILITY AND INDEMNITY

 

Whilst we will use reasonable endeavours to verify the accuracy of any information we place on the website, we make no warranties, express or implied, in relation to its accuracy. The website is provided on an “as is” and “as available” basis without any representation or endorsement made.

 

We shall not be liable for any damages that arise as a result of misuse or misconduct of our products and services available on this website.

You agree to indemnify us immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising from any breach of any of our terms and conditions.

We take photos of the flowers we have made and post them on social media and our website as marketing promotion but will not use your name if you request us not to.

Please note that some flowers may be harmful or poisonous. Please do not eat any flowers you receive and avoid their contact with children and animals. Please handle flowers carefully and wash your hands before eating or drinking. If you require further information before submitting an order please contact us.

All our petals are dye-free meaning that there are no artificial colours added. Please remember however that they are natural products and therefore I cannot completely guarantee that a colour won't leach.

 

JURISDICTION

These terms and conditions shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.
